The measure, known as Senate Bill 1234, aims to curb potential conflicts of interest and โ€œpayโ€‘toโ€‘playโ€ arrangements where officials could benefit financially from digital tokens tied to their office. If passed by the state House and signed into law, the bill would make it illegal for any federal officerโ€”such as a senator, congressman or appointed agency headโ€”to create or promote a memecoin that could be purchased by Californians.

Memecoins have exploded in popularity since the 2017 rise of Dogecoin, but they lack the regulatory safeguards that traditional securities enjoy. Critics argue that public officials could use these tokens to raise funds or influence public opinion while hiding behind the anonymity of blockchain transactions. The Senate cited a wave of scandals in which politicians launched crypto projects that promised high returns to donors, only to see the tokens collapse in value. In 2023, a former federal officialโ€™s token was seized by the SEC for fraud, and the fallout spurred lawmakers to consider tighter controls on crypto tied to public office.

The bill follows a series of highโ€‘profile incidents that raised alarm in California. In 2022, a former U.S. Treasury aide released a memeโ€‘based token that was marketed to state voters, drawing criticism from the California Attorney Generalโ€™s office. The state also saw a surge in โ€œpolitical cryptoโ€ projects during the 2023 market downturn, when many tokens lost more than 90โ€ฏ% of their value, leaving investors with worthless holdings. The Senateโ€™s proposal is part of a broader effort to protect consumers from speculative assets that lack transparency, and it aligns with Californiaโ€™s long history of pioneering consumerโ€‘protection legislation in the tech sector.

The bill now moves to the California House of Representatives for debate. If it clears the House and avoids a gubernatorial veto, it could become law by the end of the fiscal year. The crypto community has warned that the measure could set a precedent for other states, potentially stifling innovation in a rapidly evolving market. Meanwhile, legal scholars predict that the law will prompt federal agencies to review existing guidelines on cryptocurrency issuance by public officials, ensuring that similar conflicts are avoided across the country.
